SUPREME COURT’S LANDMARK RULING ON TRADEMARK USE IN DIGITAL ADVERTISING

The Supreme Court of India recently delivered a landmark judgment on the contentious issue of trademark usage in digital advertising, particularly in the context of Google Ads. The case arose from MakeMyTrip’s allegations that Google’s use of its registered trademarks ‘MakeMyTrip’ and ‘MMT’ as keywords to display competitor advertisements amounted to trademark infringement. MakeMyTrip’s claim centered on the argument that Google’s Ads Program allowed its competitors, such as Booking.com, to use its registered trademarks as keywords, potentially misleading consumers.
